Beginning Oct. 1, general contractors performing work in Maryland will be liable for a subcontractor’s failure to pay its employees in accordance with Maryland’s Wage Payment and Collection Law. Senate Bill 853 revises Maryland law to state that general contractors on construction projects are jointly and severally liable for failing to properly pay employees.
Violations of this statute may result in a court awarding the employee up to three times the amount of wages owed, counsel fees and other related costs. Employers that violate Maryland’s wage law are also guilty of a misdemeanor and may be fined up to $1,000.
