The Difference Between Arbitration and Mediation in Construction Disputes
Contractors may go into mediation and spend a significant amount of time and money only to leave with an unresolved dispute. Or, a contractor may enter an arbitration and be dissatisfied with the arbitrator’s award but has no option to appeal. Contractors beware of contracts that contain complicated or ambiguous alternate dispute resolution clauses.
